Due Diligence Checklist Before Buying Land in Kerala

J Group Consultancy8 min read

A comprehensive checklist for verifying land title, survey records, encumbrances, and regulatory compliance before purchasing property in Kerala. Avoid costly mistakes.

Kerala's complex land ownership history — spanning multiple revenue systems, partition deeds, and succession events — makes property due diligence essential before any purchase. A single missed encumbrance or title defect can result in years of litigation and total loss of investment.

1. Title Verification

Verify the chain of title for at least the last 30 years. This involves tracing every sale deed, gift deed, partition deed, and succession event in the property's history. Obtain certified copies from the Sub-Registrar's office. Check for any breaks in the chain — a missing link often indicates a disputed or fraudulent transfer.

2. Encumbrance Certificate

Obtain an Encumbrance Certificate (EC) for the last 30 years from the Sub-Registrar's office. The EC reveals all registered transactions — mortgages, liens, court orders, and attachments — against the property. A "nil" encumbrance certificate for the full period is essential for a clean purchase.

3. Survey and Boundary Verification

Request a fresh survey from the District Survey Office. Compare the survey results with the sale deed measurements and the Revenue records (thandaper). Discrepancies between the recorded area and actual area are common in Kerala and must be resolved before purchase. Walk the boundaries physically — paper records don't always reflect ground reality.

4. Data Bank and Land Classification Check

Verify whether the property is listed in the Paddy Land and Wetland Data Bank. If it is, any non-agricultural development is prohibited until conversion is completed through Form 5, 6, or 7. Check the land classification in the Village Office records — nilam (paddy), purayidam (homestead), or other categories. Classification determines what you can and cannot build.

5. Tax and Revenue Records

Verify that all property taxes (building tax, land tax) are paid up to date. Obtain a tax receipt and thandaper extract from the Village Office. Outstanding tax dues can create legal complications and, in extreme cases, government attachment of the property.

6. Local Body Approvals

Check with the local Panchayat or Municipality for any pending violations, building plan approvals for existing structures, and zoning restrictions. Some areas fall under Coastal Regulation Zone (CRZ), Western Ghats ESA restrictions, or airport height limitations — all of which severely limit development potential.

7. Physical and Environmental Assessment

Visit the property during monsoon season if possible. Kerala's heavy rainfall creates drainage, flooding, and soil stability issues that are invisible during dry months. Check for water logging, proximity to rivers or backwaters, and soil quality. Properties in landslide-prone zones (common in hilly districts like Wayanad and Idukki) require special geological assessment.

Why You Need Professional Due Diligence

Each of these checks requires local knowledge, institutional relationships, and the ability to read between the lines of official records. At J Group Consultancy, our due diligence process covers every aspect listed above, plus ground-level intelligence that no document can provide — knowledge of local disputes, political dynamics, and development plans that affect property value.

Several checks in this list have a guide of their own: the encumbrance certificate at /guides/encumbrance-certificate-kerala, the possession certificate at /guides/possession-certificate-kerala, the thandaper at /guides/thandaper-number-certificate-kerala, the Data Bank at /guides/data-bank-kerala-paddy-wetland and the fair value that will drive your stamp duty at /guides/fair-value-of-land-kerala.
