NRI Property Rights in Kerala: What Every Non-Resident Must Know

J Group Consultancy9 min read

A practical guide for Non-Resident Indians on property ownership, management, and legal rights in Kerala. Covering inheritance, power of attorney, land conversion, and common disputes.

For millions of Keralites living abroad, ancestral property in Kerala represents both emotional attachment and significant financial value. Yet managing property from thousands of miles away presents unique legal, administrative, and practical challenges that can quickly escalate into costly disputes.

Can NRIs Own Property in Kerala?

Yes. Under the Foreign Exchange Management Act (FEMA), NRIs and PIOs (Persons of Indian Origin) can purchase and own residential and commercial property in India. However, agricultural land, plantation property, and farmhouses require special permission from the Reserve Bank of India. In Kerala, where significant land parcels are classified as agricultural, this distinction is critically important.

The Power of Attorney Problem

Most NRIs manage their Kerala properties through a Power of Attorney (PoA) holder — typically a relative or family friend. While this is often necessary, it creates significant risk. We have handled numerous cases where PoA holders have sold property without the owner's knowledge, created unauthorized encumbrances, or failed to pay property taxes for years. The key protections are: using a Special Power of Attorney (limited scope) rather than a General Power of Attorney, registering the PoA with the Sub-Registrar, and conducting periodic title verification.

Inheritance and Succession

Kerala follows the Indian Succession Act for Christians and the Hindu Succession Act for Hindus. Property inherited by NRIs must be properly mutated in the Village Office records. Failure to complete mutation — a common oversight — can create complications when selling, developing, or converting the land. For NRIs inheriting ancestral property, we recommend immediate steps: obtain legal heir certificates, complete mutation, verify Data Bank status, and assess property tax arrears.

Encroachment and Boundary Disputes

Encroachment is the single most common problem NRIs face with their Kerala properties. When a property sits unattended for years, neighboring landowners gradually expand their boundaries, squatters occupy vacant parcels, or local communities use the land as thoroughfares. Resolving encroachment disputes requires a fresh survey from the District Survey Office, historical document review, and often, mediation or litigation. Early intervention is critical — the longer an encroachment persists, the harder it is to reverse.

Land Conversion for NRIs

NRIs can apply for land conversion in Kerala, but the process requires local representation. Site inspections, document submissions, and liaison with Revenue Department officials cannot be done remotely. We act as the authorized representative for NRI clients throughout the conversion process, from Form 5 Data Bank verification through Form 6/7 conversion and final order receipt.

Selling NRI Property in Kerala

Selling property in Kerala as an NRI involves additional compliance: TDS (Tax Deducted at Source) at 20% for long-term capital gains, obtaining a TAN, filing Form 27Q, and ensuring the buyer deposits the TDS with the government. Many NRIs are unaware of these requirements until the sale is blocked at the Sub-Registrar's office. Professional advisory ensures compliance and prevents last-minute deal collapses.

Three of the tasks described here are documented in detail elsewhere on this site: mutation after an inheritance at /guides/pokkuvaravu-mutation-kerala, the legal heir certificate that mutation depends on at /guides/legal-heir-certificate-kerala, and the annual land tax that protects an unattended holding at /guides/kerala-land-tax-online. If you are selling rather than keeping, /tools/nri-property-sale-tds-calculator estimates the TDS the buyer must deduct under Section 195.
